Hello, my name is John Alexander, and I am a personal injury attorney, with offices in Oakland County, practicing throughout the entire state of Michigan. Today, I want to talk to you about, if you’re injured in an automobile accident, and you have no insurance, you can still make a claim. A particular example, you’re a passenger in a car, and God forbid, someone hits you, or the person driving you is at fault, and you become injured, seriously injured, even, and you have no insurance to pay for your medical, to pay for your wage loss, Michigan has a system in place the state of Michigan known as the assigned claims plan. What that means is, if no insurance is out there to cover your claim, you call the state of Michigan and fill out a claim with a Michigan assigned claims plan. And they will assign you with an insurance company to help pay for all your first-party benefits that you’re entitled to; your wage loss, your replacement services, your medical expenses, your attendant care services, mileage to the doctors, things like that.

Now, please bear in mind that if you own a vehicle and you are driving that vehicle in the accident without insurance, this will not work. The state of Michigan then will not allow you to make a claim with a Michigan assigned claims plan. This will only work if you are, for example, driving somebody’s else’s car that is uninsured, or you could be a passenger in your own car that you forgot to get insurance and somebody else is driving, you could still make a claim that way; or if you’re on a motorcycle, or a pedestrian, even if you have no insurance covering your expenses.

The state of Michigan will assign you an insurance company, and all the insurance companies in the state of Michigan rotate in taking these claims. It’s called the Michigan Assigned Claims Plan, and you go to www.michapcp.org You log on to there, and you can find a claim form, download it, fill it out, and mail it to the state of Michigan, and an insurance company will be assigned to you. A claims adjuster will be assigned to you. And you’ll probably have to fill out an affidavit of no insurance, and things like that. But that is a way to get coverage if you don’t have insurance.
